Buyer Agreement

1. Vehicle Sale Terms

By purchasing a vehicle through Ivory Auto, you agree to the following terms and conditions governing the sale and export of vehicles.

2. Vehicle Condition

• All vehicles are sold "as-is" unless otherwise specified in writing.
• Vehicle descriptions and condition reports are provided in good faith but do not constitute warranties.
• Buyers are encouraged to arrange independent inspections before purchase.
• Ivory Auto is not responsible for undisclosed defects discovered after delivery.

3. Payment Terms

• Full payment must be received before vehicle shipment.
• Accepted payment methods: Wire transfer, Bitcoin, Credit Card (+3% fee).
• Payment holds vehicle for 72 hours pending export documentation.
• Prices are in USD and do not include shipping costs unless specified.

4. Export and Shipping

• Buyer is responsible for complying with their country's import regulations.
• Ivory Coast Decree 792/2017 compliance is the buyer's responsibility to verify.
• Shipping timelines are estimates and subject to customs processing delays.
• Risk of loss transfers to buyer upon delivery to the shipping carrier.

5. Documentation

• Original title will be provided with export documentation.
• Buyer must provide valid identification and import permits if required.
• Export paperwork processing takes 5-10 business days from payment confirmation.

6. Cancellation Policy

• Orders may be cancelled within 24 hours of payment for full refund.
• After 24 hours, cancellations incur a 10% administrative fee.
• No refunds after vehicle has been shipped.

7. Legal Compliance and Export Regulations

• All transactions comply with U.S. Export Administration Regulations (EAR), International Traffic in Arms Regulations (ITAR) where applicable, and Office of Foreign Assets Control (OFAC) sanctions.
• Buyer certifies vehicle is not intended for prohibited end uses or export to sanctioned entities/countries.
• Ivory Coast Decree 792/2017 requires vehicles to be less than 5 years old and meet Euro 4 emissions standards. Buyer is solely responsible for verifying compliance.
• Violation of export laws may result in civil and criminal penalties.

8. Limitation of Liability

Ivory Auto's liability is limited to the purchase price of the vehicle. We are not liable for indirect, incidental, or consequential damages arising from the purchase or use of any vehicle.

9. Governing Law and Dispute Resolution

This agreement is governed by the laws of the State of Florida, USA. Any disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules in Miami-Dade County, Florida. The arbitrator's decision shall be final and binding. Each party bears its own costs; the prevailing party may recover reasonable attorney fees. BY AGREEING TO THESE TERMS, BOTH PARTIES WAIVE THEIR RIGHT TO A JURY TRIAL AND AGREE THAT CLASS ACTION PROCEEDINGS ARE PROHIBITED. Either party may opt out of arbitration within 30 days of account creation by written notice to support@psdepot.com.

10. Force Majeure

Ivory Auto shall not be liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to: customs delays, port congestion, shipping delays, regulatory changes, export license delays, acts of government, natural disasters, or pandemic. In such events, timelines will be extended and reasonable accommodations made.

11. Severability

If any provision of this agreement is found invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable.

12. Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated by reference.
